These Terms and Conditions outline the rules and regulations for the use of Hope and Goodness, LLC's website, located at https://hopeandgoodness.com, and the Hope and Goodness mobile application ("the App").

By accessing the website or downloading and using the App, we assume you accept these Terms and Conditions in full. Do not continue to use Hope and Goodness if you do not agree to all of the terms and conditions stated on this page.

1. About Hope & Goodness

Hope and Goodness, LLC is a wellness platform designed to support personal support, growth and emotional wellbeing. Our website and App provide:

• Self-paced support and personal development courses

• An AI wellness coach called Hope

• Mindfulness tools and exercises

• Journaling and mood tracking features

• Gratitude and affirmation practices

• Faith-based support resources

Important: Hope and Goodness is a wellness and personal development platform. It is not a medical service, mental health service, or therapy platform. Nothing on the website or in the App constitutes professional medical, psychological, psychiatric or therapeutic advice. If you are experiencing a mental health crisis, please contact a qualified professional or crisis service immediately.

2. Eligibility

You must be at least 17 years old to use Hope and Goodness. By using the website or App, you confirm that you are 17 or older.

3. Cookies (Website)

The website uses cookies to help personalise your online experience. By accessing Hope and Goodness, you agree to use the required cookies.

A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.

4. Account Registration (App)

To access most features of the App, you must create an account. You agree to:

• Provide accurate and complete information when creating your account

• Keep your password secure and confidential

• Notify us immediately if you suspect unauthorised access to your account

• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account if you breach these Terms.

5. Subscriptions and Payments (App)

5.1 Subscription Plans

Hope and Goodness offers a subscription to access premium App content. Subscription details, pricing and billing periods are displayed in the App and on the App Store listing.

5.2 Billing

All subscriptions are billed through Apple's App Store. By subscribing, you authorise Apple to charge the subscription fee to your Apple ID account. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

5.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for unused portions of a subscription period except where required by applicable law.

5.4 Restore Purchases

If you have previously subscribed, you may restore your subscription using the "Restore Purchases" option in the App's Settings screen.

5.5 Price Changes

We may change subscription pricing at any time. If we increase your subscription price, we will provide notice and you will have the opportunity to cancel before the new price takes effect.

6. The AI Coach — Hope

The App includes an AI wellness coach called Hope, powered by Anthropic's Claude AI. By using the Hope chat feature, you acknowledge and agree that:

• Hope is an AI assistant and not a human therapist, counsellor or mental health professional

• Conversations with Hope are not confidential in the way that conversations with a licensed therapist are

• Hope may make errors or provide information that is incomplete or inaccurate

• Hope is not a substitute for professional mental health care, crisis support, or medical advice

• If you are in crisis or experiencing thoughts of self-harm or suicide, please contact a crisis service immediately — in the US call or text 988, in Australia call Lifeline on 13 11 14, in the UK call Samaritans on 116 123

We reserve the right to modify, suspend or discontinue the Hope AI feature at any time.

7. Course Content (App)

The courses and educational content available in the App are for personal development and general wellbeing purposes only. Course content:

• Is based on research, personal experience and coaching principles

• Is not a substitute for professional therapy or medical treatment

• Should not be used to diagnose or treat any mental health condition

8. Intellectual Property and License

Unless otherwise stated, Hope and Goodness, LLC and/or its licensors own the intellectual property rights for all material on the Hope and Goodness website and App. All intellectual property rights are reserved. You may access content from Hope and Goodness for your own personal use, subject to the restrictions set in these Terms and Conditions.

You must not:

• Copy or republish material from Hope and Goodness

• Sell, rent, or sub-license material from Hope and Goodness

• Reproduce, duplicate or copy material from Hope and Goodness

• Redistribute content from Hope and Goodness

• Reverse engineer, decompile or modify any part of the App

This Agreement shall begin on the date hereof.

9. User Comments and Content

Parts of the website and App offer users an opportunity to post and exchange opinions and information. Hope and Goodness, LLC does not filter, edit, publish or review comments before their presence on the platform. Comments do not reflect the views and opinions of Hope and Goodness, LLC, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts them. To the extent permitted by applicable laws, Hope and Goodness, LLC shall not be liable for any comments or any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of comments on this platform.

Hope and Goodness, LLC reserves the right to monitor all comments and remove any that can be considered inappropriate, offensive, or in breach of these Terms and Conditions.

You warrant and represent that:

• You are entitled to post comments and have all necessary licences and consents to do so

• Your comments do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party

• Your comments do not contain any defamatory, libellous, offensive, indecent, or otherwise unlawful material

• Your comments will not be used to solicit or promote business or present commercial activities or unlawful activity

You hereby grant Hope and Goodness, LLC a non-exclusive licence to use, reproduce, edit and authorise others to use, reproduce and edit any of your comments in any and all forms, formats, or media.

10. Acceptable Use

You agree not to use the website or App to:

• Violate any applicable law or regulation

• Harass, abuse or harm any other person

• Upload or transmit any content that is illegal, harmful, offensive, or infringes the rights of others

• Attempt to gain unauthorised access to any part of our platforms or systems

• Use our platforms for any commercial purpose without our written consent

11. Hyperlinking to Our Content

The following organisations may link to our website without prior written approval:

• Online directory distributors, in the same manner as they hyperlink to the websites of other listed businesses

No links should appear on any website that may be interpreted as libellous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of any third-party rights.

We reserve the right to request that you remove all links or any particular link to our website. You agree to immediately remove all links to our website upon request. We also reserve the right to amend these Terms and Conditions and our linking policy at any time. If you find any link on our website that is offensive for any reason, you are free to contact and inform us at any time. We will consider requests to remove links, but we are not obligated to do so or to respond to you directly.

The limitations and exclusions of liability set in this section and elsewhere in this disclaimer govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort, and for breach of statutory duty.

The Hope AI coach may produce inaccurate, incomplete or inappropriate responses. We do not warrant the accuracy, completeness or suitability of any AI-generated content.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Hope and Goodness, LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the website or App, including but not limited to loss of data, loss of profits, or emotional distress.

Our total liability to you for any claim arising from these Terms or your use of our platforms shall not exceed the amount you paid to us in the 12 months preceding the claim.

19. Governing Law and Disputes

• For users in Australia: governed by Australian law, subject to the jurisdiction of Australian courts

• For users in the United Kingdom: governed by English law, subject to the jurisdiction of English courts
